These Terms of Use govern access to and use of the Cosmo website at cosmopoints.com (the "Website"). The Website is operated by Cosmopoints Loyalty Tech Ltd, a company registered in the Dubai International Financial Centre, Dubai, United Arab Emirates ("Cosmo").

By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Scope

These Terms apply to the public Website only. Access to the Cosmo customer portal (portal.cosmopoints.com), the Cosmo API and any Cosmo services is governed by separate terms and by any written agreement between Cosmo and the customer. If those terms conflict with these Terms, those terms prevail.

2. Use of the Website

You may use the Website for lawful purposes, including learning about Cosmo and contacting Cosmo. You agree not to:

• use the Website in any way that breaches applicable law or regulation;
• attempt to gain unauthorised access to the Website, its servers or any connected system;
• interfere with or disrupt the operation or security of the Website, including by introducing malicious code;
• use automated means to scrape, copy or extract content from the Website, except for standard search engine indexing;
• submit false or misleading information through any form on the Website; or
• use the Website to send unsolicited commercial communications.

3. Intellectual property

The Website and its content, including text, graphics, design, software and the Cosmo name and logo, are owned by Cosmo or its licensors and are protected by intellectual property laws. Cosmo's Multibrand technology is protected by US patent 12,597,048.

You may view and print content from the Website for your own internal, non-commercial use. You may not copy, modify, distribute, sell or create derivative works from any part of the Website without Cosmo's prior written consent.

Names, logos and trademarks of loyalty programs, airlines, hotels and other third parties shown on the Website belong to their respective owners. Their display does not grant you any right to use them.

4. Information on the Website

Content on the Website is provided for general information only. It does not constitute an offer, a commitment to provide any service, or financial, legal or other professional advice. Product features, availability and partner programs may change without notice.

Information about other companies, including on comparison pages, is based on publicly available sources at the date stated on the relevant page. Cosmo makes reasonable efforts to keep it accurate but does not guarantee that it is complete or current.

The Website may link to websites operated by third parties. Cosmo does not control and is not responsible for their content, policies or practices. Accessing them is at your own risk and subject to their terms.

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of the Dubai International Financial Centre. The courts of the Dubai International Financial Centre have exclusive jurisdiction over any such dispute or claim.
